These Terms of Service (“Terms”) govern your use of Subtly’s website, API, and MCP integrations (the “Service”), operated by Tigro (Obrt Tigro Vlasnik Žilić Ajsel), a sole proprietorship registered in Bosnia and Herzegovina (“we”, “us”). By creating an account or using the Service, you agree to these Terms.
Your content and rights
You retain ownership of the content you upload. You represent that you own it or have the rights and permissions needed to process it through the Service, including permission to process other people’s recordings or personal data. You are responsible for ensuring your use does not infringe third-party rights.
You grant us a limited license to store and process your content solely to provide transcription, subtitle translation, and delivery of results. We never use your content to train or fine-tune AI models, or sell or license it for that purpose.
Accounts and integrations
You must provide accurate registration information and keep your credentials and API keys secure. You are responsible for activity under your account and the access you grant to workspace members and connected applications. Contact us to request account deletion.
You may use our API and MCP integrations in your own applications and workflows. You are responsible for the instructions you give connected tools and the destinations you choose for your content.
Credits and billing
Subtly is pay-per-use, with prepaid credits and no recurring subscription. Transcription is charged by audio duration; subtitle translation is charged by source text and target language. Applicable rates and minimum charges are shown in the Service before you submit work.
Credits may be reserved when a job is submitted and settled according to its outcome. Your billing history shows the resulting charges and adjustments. Contact us if you believe a charge is incorrect. Purchased credits are non-refundable except where required by law or the applicable payment-provider terms.
Your first workspace receives $1 in trial credits once you verify your email, once per person and email address. Top-ups earn $0.10 in bonus credits per $1 above $5, rounded down to a cent. Refunds reverse the corresponding bonus credits.
Promotional credits have no cash value. Promotional credits associated with a purchase may be adjusted or removed if that purchase is refunded or reversed. Future rate changes do not change charges for work already accepted.
Acceptable use
You agree not to:
- Submit content you do not have the rights or permissions to process.
- Use the Service to violate the law, privacy, copyright, or other third-party rights.
- Attempt to bypass security, access another customer’s data, or disrupt or overload the Service.
- Abuse accounts, credits, rate limits, or connected applications.
Generated output
Transcription and translation are automated, AI-assisted processes. Results may contain errors and vary with the source material and language. Review outputs before relying on them, especially where accuracy affects other people. We do not guarantee a specific accuracy or quality outcome.
Temporary files
Managed output files are available to download for up to 24 hours after processing finishes. Download the results you want to keep before they expire. The Service is not a permanent archive. Our Privacy Policy explains source-file cleanup, deletion retries, provider retention limits, and separate retention of account and billing records. Copies you download or send to your own systems, and originals at source URLs you import, follow their own retention settings. All uploads and results within the Service use private storage managed by us.
Website analytics
We use cookieless Umami analytics, hosted by Tigro, to understand visits to our public pages and improve the website. It does not set tracking cookies or track you across sites. We keep account activity and your content out of analytics and never use it for advertising profiles. See our Privacy Policy and Cookie Policy for details.
Service availability
The Service is provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation. We may modify, suspend, or discontinue features, subject to applicable law and your mandatory consumer rights.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or loss of data or profits arising from your use of the Service. Our total liability for a claim is limited to the amount you paid us for credits in the twelve months preceding the claim. These limits do not exclude liability that cannot lawfully be excluded or limit mandatory consumer rights.
Governing law and disputes
These Terms are governed by the laws of Bosnia and Herzegovina, without regard to conflict-of-laws rules. Disputes shall be brought before the competent courts of Bosnia and Herzegovina, except where mandatory law provides otherwise. Nothing in these Terms limits mandatory consumer rights, including rights available under the laws of your country of residence.
Changes to these Terms
When we update these Terms, we revise the date above. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance, subject to any notice or consent required by applicable law.
